What is Joe’s opinion of the ruling in CO re Donald was involved in insurrection,,but somehow the President isn’t covered by 14th Amendment Sec 3?;and even the judge dislikes their own ruling

Hi Mary, I haven’t had a chance to listen to the courtroom dialogue video that you posted, and I won’t be able to look at anything else until this evening. But, my question is: Does Joe Gallina see any hope for Donald being detained in some way prior to his trial starting (assuming he defies a reinstated gag order, and I don’t see how he will be able to avoid that), even if it’s just putting him under house arrest and having his social media privileges removed? It’s this ability to rile up his base that is making everything really horrible. As an aside, I’m noticing that the right wing trolling on Substack is just out of control on some sites. I believe this is related to the whole issue of Donald having access to his rabid MAGA base.

Can you ask him why Trump’s speech and posts prior to the Insurrection are not enough to form the non-hypothetical conclusion that additional threatening speech will again represent danger to others and to the fair judicial process!?!

I don’t understand why political candidates have speech that is more protected than you or me. He’s just a citizen. Plumbers don’t run their mouths off like TFG does and not incur consequences. Why is his HATE speech protected? I just can’t wrap my head around his royal highness’s special treatment. Are we more worried about his rights or his mob at this point?

Michael Cohen said that if Donald were to be locked up, they will consider home confinement. I think that would be awful for the USA, he would still have the ability to use social media to reach his followers. I think he should be housed in a federal lock up facility, a military base lock up or a federal prison. If you let him text, he will continue to rape our country for his own gratification.

They might be able to remove social media privileges. That would help if they detain him at home. But I don’t think the judge will do that because it will seem like she’s interfering with the election. I’m getting sick of the way these judges are tiptoeing around everything related to his outrageous behavior.

There was some disagreement in comments in Mary’s Substack about the Judge’s aggressive demeanor while questioning t-rump’s lawyer. At what point is a Judge’ s “ smack-down” warranted? Will Trump use this to delay some more?

Nancy, I listened to the tape, and I didn’t feel it was a smack down. She’s allowed to control the courtroom, and Trump’s attorney was being a evasive. She had to get an answer, so she could make consider them in her opinion. And she needs to ensure his protests could be properly clarified and addressed to avoid an appeal. Being evasive is a tactic. The attorney, John Sauer has argued before the SCOTUS. He knows how to behave in court, and he was dismissive of Judge Millett’s question. She was sharp with him. But when she became sharp with him, he couldn’t produce a straight answer. I think he lost, and he won’t have any grounds to appeal. He knows it and that’s why he was being so evasive thinking that tactic would work. That’s my opinion. Appeals aren’t centered on whether the judge was sharp after an attorney was evasive This is the attorney who was Missouri Solicitor General, who led the charge along with Texas AG Paxton to disallow the electors from Pennsylvania, Georgia, Wisconsin and Michigan Michigan. From what I heard, he was avoiding answering, whether Trump posting a picture of someone on social media increase the likelihood of that person being targeted, the answer is: “A above yes.” Sauer was hired specifically to handle this appeal and he relied on the Nebraska Supreme Court case in his written appeal and then he stood in front of her and said he didn’t understand the Nebraska case. She was just fed up with him.

The Nebraska case said posting these kinds of things on social media, made it more probable that it would happen, and he was arguing the opposite and the judge had read Nebraska. She wanted to pin him down, and he was evasive. I thought she was actually quite generous. But when your life entails: “Oh great, it’s Friday only three more workdays till Monday” as does mine, then I’m ready to slap him silly for taking everybody’s time. Trump was taught delay delay delay by Roy Cohn. So now Trump the non-lawyer who is in trouble but trying to run his own law case, is trying to school these guys on how to delay. I think the game’s up. Just my opinion. When they hearings, Judge McCafee asked similar questions. Attorneys were all respectful and answered.

Hi Nancy, The lead attorney, John Lauro, forgot to fill out the paperwork that would allow him to appear before the DC district court judges. He’s been working in Florida. Did he really think he could go to court and not have his paperwork filed? (my take on that is Lauro knew absolutely that they were going to lose in appealing the gag order in court in DC so he purposely didn’t file his paperwork and let the other attorney take the fall). He has defended money laundering, and racketeering (mafia like don-Don) and public corruption. He has a lot of experience to defend a morally, corrupt, ethically deficient person.

Jack Smith, taking the high road, is going to win his cases. you don’t have to worry about slipping up when you tell the truth. And Trump own attorneys are testifying against him. Several are on record, but we also have a couple who are talking behind the scenes.

I'd appreciate a few minutes discussion of what is REALLY going on behind the judicial curtain that is preventing judges from punishing Donald's acting out as severely as they have surely punished other defendants in the past. What is the hold up? the hesitation? In terms us non-lawyers can understand. What we are seeing with our own eyes screams "two tiered justice system" -- is that really all that's going on? A two-tiered American justice system?

Sorry Mary I truly admire you but I’m a senior citizen without a lot of money so I can’t afford any money as I am nursing my dying husband who has pancreatic cancer. My one and child arrives from DC on Friday so I will have some help. Just keep up the good work and get that crazy dude locked up before he does something we will all regret.

BTW perhaps you can remind people that Joe is a stutterer hence the hesitation in his speech. People sure have lousy memories. 😢

Surprisingly, talking to my passed loved one (out loud, only when alone) was what I've done a lot of, and somehow, it has brought me a closeness and peace that I was not expecting, Just passing on a couple tools for the future, if it is something that might be of service to you as you travel through your grief. Update on my dying darling, he passed on the 7 December had to send him back to hospital where he contracted Covid. Which on reflection might of freed him from the pain that would have come from the cancer.

I have truly lost my best friend but I’m boxing on. I greet him every morning and blow him kisses on my way to bed and call him at various times of the day.

Why does Mr. Gallina believe Jack Smith hasn't asked Judge Cannon to recuse herself. Initially heard that despite bad rulings last year, they weren't pertinent to the new case. Have heard that it would delay trial (don't see how it can be delayed anymore than she'll delay it, however). Is it that given the discretion of a district court judge, though it's obvious that she's not following standard legal procedure, that she's not done anything that's outside her prerogative?

Why is he just let to say, do, and threatening the judges and others? If this was anyone else, they

would be locked up and the key thrown away. Don't they see that he is telling them to their face

what he is going to do to them if re-elected? He would round each and every one of them up and

have them killed. Are they all scared of him? They all act as if they are scared to bring him to justice.

I’m sorry that this isn’t strictly a legal question. Why are those judges walking on eggshells? Why are our expectations of someone who wants to hold the highest office in the land so low? I know that there was a time when it would have been unthinkable that the President would be anything less than dignified and thoughtful in choosing their words and expressing their opinions. They wouldn’t have to be told that their words mattered, or that it was wrong to threaten, imply, or say anything that could leave people fearing for their safety! Thank you all!
