The NEW audio of Donald bragging about January 6 could be explosive evidence in Judge Tanya Chutkan's courtroom. The recording was released by ABC News' Jonathan Karl as part of their interview. Analysis from lawyers, along with my own, follows.
I know from personal experience that Donald can’t help but bluster himself into trouble. But I’m not alone:
Esteemed former federal prosecutor Jennifer Rogers thinks this audio could be key evidence in Jack Smith’s January 6 case.
The consensus? Donald’s penchant for baseless swagger has spelled disaster for his case.
First, Donald brags about the size of his January 6 crowd.
“If you look at the real size of that crowd, it was never reported correctly,' Trump said. 'There were— it's the biggest crowd I've ever spoken in front of by far. By far,” Donald says.
Prosecutor Jennifer Rogers says, “the fact that he's recorded saying, basically, ‘I knew that these were my supporters — they were there to do what I wanted them to do to stop the certification’ is good evidence of his participation," she stated.
This could be used a blanket admission the people were there for him, quashing any frivolous argument that the crowd was comprised of Antifa or “deep state” actors against him.
Then Donald digs himself a deeper hole, quickly.
He admits that he thought about stopping the violence, but did not.
“I was thinking about going back during the problem to stop the problem, doing it myself. Secret Service didn't like that idea too much,” Trump said.
Why is this important?
Attorney Joe Gallina of Call to Activism told me:
“For hours on January 6, Donald Trump did absolutely nothing to stop the violence, killing, and potential assassination of his own Vice President. If prosecutors draw the nexus that Donald Trump knew these were HIS people, that they turned violent, and did absolutely NOTHING to stop it with such a flimsy excuse as implying the Secret Service didn’t like it, it is superb evidence to show his intentions.”
“Jack Smith could present it as: ‘Here you have the most prolific Tweeter, someone who could call a press conference and have the entire mainstream media salivating over every word, become silent for the first time in his life.’ To any jury, this is persuasive – Donald riled up a crowd to block certification, knew they were being violent to achieve his aim, and did nothing to stop them,” Gallina concluded.
Rogers explains that this all comes down to proving conspiracy:
"They have charged him, of course, with this vast conspiracy to effectively steal the election… This is all evidence of that conspiracy, right, because the insurrection of course was the last ditch effort to stop Congress from certifying the vote,” Rogers concluded.
You might think Donald will never be held accountable. But I know Donald personally. And I can tell you his Achilles' heel – his pathetically inflated sense of himself. Exploiting that is Jack Smith’s pathway to a conviction.
